What is ESOS?
The Energy Savings Opportunity Scheme (ESOS) is a mandatory energy assessment scheme for large UK organisations and is overseen by the Environment Agency. It requires qualifying businesses to:

Measure total energy consumption across buildings, transport and production processes.

Conduct detailed energy audits to identify cost-effective savings.

Report compliance to the Environment Agency every four years.

ESOS applies across the UK and is currently in Phase 4, with a compliance deadline of 5th December 2027.
Do I need to comply with ESOS?
You must take part in ESOS if, on the qualification date - 31st December 2026, your organisation:

Employs 250 or more people
and / or
-
Has an annual turnover above £44 million and an annual balance sheet total above £38 million.

What’s involved in an ESOS Assessment?
To comply with ESOS, your organisation will need to:

Appoint an ESOS Lead Assessor recognised by the Environment Agency. They will in turn:

Measure your total energy consumption.

Identify areas of significant energy usage (at least 95% of your total).
-
Undertake compliant energy audits, covering buildings, transport and industrial processes.

Produce recommendations for reducing energy use and improving efficiency.

Review and produce an overall ESOS report.

Get the report signed-off at board level.

Assist you in submitting a compliance notification to the Environment Agency.

Penalties for Non-Compliance
Failing to comply with ESOS can result in significant penalties from the Environment Agency. These include:

Fixed penalties of up to £50,000 per infringement (stackable).
-
Additional daily fines of up to £500 per day (for up to 80 days).
-
Publication of non-compliant status on the Government’s website.

Enforcement notices requiring you to take immediate action.

Failure to undertake audits, maintain adequate records, or submit a compliance notification by the deadline can all trigger enforcement penalties. It’s far more cost-effective, and reputationally safer, to get ahead of the deadline and comply fully.
When is an ESOS Lead Assessor not required?

If your organisation’s total energy consumption is less than 40,000 kWh during the compliance period. In this case, two board-level directors must review and sign off your assessment instead.

If 100% of your energy use is covered by a valid ISO 50001 certification. This is considered a complete alternative route to compliance and no Lead Assessor is required in that case.
Who is exempt from ESOS?
Organisations below the financial & staffing thresholds outlined above.
Public bodies are not required to comply with ESOS if they are classified as public bodies under the Public Contracts Regulations 2015 (or Scottish equivalents), and they do not operate as an “undertaking” i.e. they are not engaged in economic activity on a commercial basis. This includes:

Local authorities

NHS trusts

Government departments

Most universities and publicly funded schools

However, public sector organisations may be required to comply if:
​

They are trading arms or subsidiary companies of public bodies, and
-
They meet the ESOS criteria for large undertakings (e.g. 250+ employees, £44m+ turnover and £38m+ balance sheet total)
-
These subsidiaries are considered “undertakings” and therefore must comply with ESOS unless they are fully covered by an ISO 50001-certified energy management system.
